1. Acceptance of Terms

By accessing, browsing, or using HytaleList.org (the “Site”, “Service”, “Platform”, “we”, “us”, or “our”), you (“User”, “you”, or “your”) acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service (“Terms”, “Agreement”) and our Privacy Policy. If you do not agree to these Terms, you must immediately cease using the Service.

These Terms constitute a binding legal agreement between you and HytaleList.org. Your use of the Service signifies your acceptance of these Terms, whether or not you register for an account.

2. Description of Service

HytaleList.org is a directory and listing platform that provides information about third-party Hytale game servers (“Listed Servers”). We act solely as an intermediary platform that allows server operators to list their servers and users to discover them.

IMPORTANT: We do not own, operate, control, manage, or have any affiliation with any of the Listed Servers. We are not responsible for the operation, content, availability, security, or any aspect of any Listed Server.

We are not affiliated with, endorsed by, or sponsored by Hypixel Studios, Riot Games, or Hytale. All trademarks and game assets belong to their respective owners.

3. User Eligibility and Account Security

You must be at least 13 years of age to use this Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

If you create an account, you are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your account information.

4. User Conduct and Prohibited Activities

You agree not to:

• Manipulate, interfere with, or attempt to manipulate voting systems, server rankings, or any other features of the Service;
• Use bots, scripts, or automated systems to interact with the Service, including but not limited to vote manipulation, data scraping, or spam;
• Upload or transmit viruses, malware, or any other malicious code;
• Attempt to gain unauthorized access to any portion of the Service, other users' accounts, or any systems or networks connected to the Service;
• Interfere with or disrupt the Service or servers or networks connected to the Service;
• Collect or store personal data about other users without their express permission;
• Use the Service for any illegal purpose or in violation of any local, state, national, or international law;
• Violate any intellectual property rights of others;
• Post or transmit any advertising, promotional materials, or spam without our express written consent.

We have no control over, do not endorse, and assume no responsibility for the content, privacy policies, terms of service, practices, or safety of any External Sites. This includes but is not limited to:

• The operation, security, or availability of any Listed Server;
• Any content, data, software, products, or services available on or through External Sites;
• Any harm, damage, or loss caused by or in connection with your use of or reliance on External Sites;
• Any actions taken by server operators, administrators, or other users on External Sites;
• Any violations of your rights by third parties on External Sites;
• Any malware, viruses, or security vulnerabilities on External Sites;
• Any financial transactions, donations, or purchases made through External Sites;
• Any personal data collected by External Sites.

YOU ACKNOWLEDGE AND AGREE THAT WE SHALL NOT BE RESPONSIBLE OR LIABLE, DIRECTLY OR INDIRECTLY, FOR ANY DAMAGE OR LOSS CAUSED OR ALLEGED TO BE CAUSED BY OR IN CONNECTION WITH YOUR USE OF OR RELIANCE ON ANY EXTERNAL SITES.

When you leave our Site to access External Sites, you do so at your own risk. We strongly encourage you to read the terms and conditions and privacy policies of any External Sites you visit.

6. User Safety and Personal Responsibility

YOU ARE SOLELY RESPONSIBLE FOR YOUR OWN SAFETY AND SECURITY WHEN USING THIS SERVICE AND ANY LISTED SERVERS.

You acknowledge and agree that:

• You are responsible for conducting your own due diligence before joining any Listed Server;
• You should never share personal information (including but not limited to your real name, address, phone number, financial information, or passwords) with server operators or other users;
• You are responsible for protecting your own computer systems, devices, and data, including using appropriate antivirus and security software;
• We cannot verify the identity, legitimacy, or trustworthiness of server operators or other users;
• Server listings, descriptions, and user reviews may be inaccurate, outdated, or fraudulent;
• You access all Listed Servers at your own risk and should take appropriate precautions;
• You are responsible for complying with all applicable laws and regulations in your jurisdiction;
• Interactions with other users, server operators, or third parties are solely between you and such parties.

7. User-Generated Content

The Service allows users to post, upload, and share content, including but not limited to server descriptions, reviews, comments, images, and other materials (“User Content”).

You retain all ownership rights in your User Content. However, by submitting User Content to the Service, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display your User Content in connection with operating and providing the Service.

You represent and warrant that:

• You own or have the necessary rights to your User Content;
• Your User Content does not infringe any third-party rights;
• Your User Content complies with these Terms and all applicable laws;
• Your User Content is accurate and not misleading.

We reserve the right, but are not obligated, to monitor, review, edit, or remove any User Content at our sole discretion, for any reason or no reason, at any time, without notice to you. We do not endorse any User Content or any opinion, recommendation, or advice expressed therein.

8. Content Moderation and Account Termination

We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates these Terms, including but not limited to:

• Removing or editing User Content;
• Suspending or terminating accounts;
• Removing server listings;
• Reporting users to law enforcement authorities;
• Taking legal action.

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

9. Intellectual Property Rights

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of HytaleList.org and its licensors. The Service is protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Service or included software, nor may you reverse engineer or attempt to extract the source code of that software, unless laws prohibit these restrictions or you have our written permission.

10. DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

WE DO NOT WARRANT, ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY PRODUCT OR SERVICE ADVERTISED OR OFFERED BY A THIRD PARTY THROUGH THE SERVICE OR ANY EXTERNAL SITE.

11. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HYTALELIST.ORG, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, data, or use;
• Loss of or damage to property;
• Personal injury or death;
• Business interruption;
• Loss of goodwill;
• Computer failure or malfunction;
• Any other commercial damages or losses;

ARISING OUT of or related to your use or inability to use the service, any listed servers, external sites, or any user content, even if we have been advised of the possibility of such damages.

In no event shall our total liability to you for all damages exceed the amount of one hundred dollars ($100.00) or the amount you have paid us in the past twelve months, whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you. In such cases, our liability will be limited to the fullest extent permitted by applicable law.

12. Indemnification

You agree to defend, indemnify, and hold harmless HytaleList.org, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to:

• Your violation of these Terms;
• Your use of the Service;
• Your User Content;
• Your interaction with any Listed Server or External Site;
• Your violation of any rights of another person or entity;
• Your violation of any applicable laws or regulations;
• Any claim that your User Content caused damage to a third party.

13. DMCA Copyright Policy

We respect the intellectual property rights of others. If you believe that any content on the Service infringes your copyright, please contact us with the following information:

• A description of the copyrighted work that you claim has been infringed;
• A description of where the allegedly infringing material is located on the Service;
• Your contact information;
• A statement that you have a good faith belief that the use is not authorized;

14. Governing Law and Dispute Resolution
